This privacy policy explains the type, scope and purpose of the processing of personal data (hereinafter referred to as "data") within our online offering and the associated websites, functions and content as well as external online presences, such as our social media profiles (hereinafter jointly referred to as "online offering"). With regard to the terms used, such as "processing" or "controller", we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).<\/p>\n

\u201cPersonal data\u201d means any information relating to an identified or identifiable natural person (hereinafter referred to as \u201cdata subject\u201d); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. a cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.<\/p>\n

\u201cProcessing\u201d means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means. The term is broad and covers practically any handling of data.<\/p>\n

\u2018Pseudonymisation\u2019 means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.<\/p>\n

\u2018Profiling\u2019 means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person\u2019s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.<\/p>\n

The \u201ccontroller\u201d means the natural or legal person, public authority, agency or other body which alone or jointly with others decides on the purposes and means of the processing of personal data.<\/p>\n

\u201cProcessor\u201d means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.<\/p>\n

<\/span>Relevant legal bases<\/span><\/h3>\n

In accordance with Art. 13 GDPR, we will inform you of the legal basis for our data processing. If the legal basis is not mentioned in the data protection declaration, the following applies: The legal basis for obtaining consent is Art. 6 Para. 1 lit. a and Art. 7 GDPR, the legal basis for processing to fulfill our services and carry out contractual measures as well as answering inquiries is Art. 6 Para. 1 lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 Para. 1 lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Art. 6 Para. 1 lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 Para. 1 lit. d GDPR serves as the legal basis.<\/p>\n

In accordance with Art. 32 GDPR, we take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons.<\/p>\n

The measures include in particular ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to it, input, transfer, ensuring availability and separation. Furthermore, we have set up procedures that ensure the exercise of data subject rights, deletion of data and response to data threats. Furthermore, we take the protection of personal data into account when developing or selecting hardware, software and processes, in accordance with the principle of data protection through technology design and through data protection-friendly default settings (Article 25 GDPR).<\/p>\n

<\/span>cooperation with processors and third parties<\/span><\/h3>\n

If, as part of our processing, we disclose data to other persons and companies (contract processors or third parties), transmit it to them or otherwise grant them access to the data, this will only be done on the basis of a legal permission (e.g. if a transmission of the data to third parties, such as payment service providers, is necessary to fulfill the contract in accordance with Art. 6 Para. 1 lit. b GDPR), you have consented, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).<\/p>\n

If we commission third parties to process data on the basis of a so-called \u201corder processing agreement\u201d, this is done on the basis of Art. 28 GDPR.<\/p>\n

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs as part of the use of third-party services or disclosure or transmission of data to third parties, this will only occur if it is necessary to fulfil our (pre)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we only process or have data processed in a third country if the special requirements of Art. 44 ff. GDPR are met. This means that the processing takes place, for example, on the basis of special guarantees, such as the officially recognised determination of a data protection level corresponding to that of the EU (e.g. for the USA through the \u201cPrivacy Shield\u201d) or compliance with officially recognised special contractual obligations (so-called \u201cstandard contractual clauses\u201d).<\/p>\n

<\/span>rights of the data subjects<\/span><\/h3>\n

You have the right to request confirmation as to whether or not data concerning you is being processed and to request information about this data as well as further information and a copy of the data in accordance with Art. 15 GDPR.<\/p>\n

According to Art. 16 GDPR, you have the right to request that the data concerning you be completed or that inaccurate data concerning you be corrected.<\/p>\n

In accordance with Art. 17 GDPR, you have the right to request that the data in question be deleted immediately or, alternatively, to request that the processing of the data be restricted in accordance with Art. 18 GDPR.<\/p>\n

You have the right to request that we receive the data concerning you that you have made available to us in accordance with Art. 20 GDPR and to request that it be transmitted to other responsible parties.<\/p>\n

You also have the right to lodge a complaint with the competent supervisory authority in accordance with Art. 77 GDPR.<\/p>\n

You have the right to revoke consent granted in accordance with Art. 7 Para. 3 GDPR with effect for the future<\/p>\n

You can object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. The objection can be made in particular against processing for direct marketing purposes.<\/p>\n

<\/span>Cookies and the right to object to direct advertising<\/span><\/h3>\n

\u201cCookies\u201d are small files that are saved on users\u2019 computers. Different information can be saved within cookies. A cookie is primarily used to save information about a user (or the device on which the cookie is saved) during or after their visit to an online service. Temporary cookies, or \u201csession cookies\u201d or \u201ctransient cookies\u201d, are cookies that are deleted after a user leaves an online service and closes their browser. Such a cookie can store, for example, the contents of a shopping cart in an online shop or a login status. \u201cPermanent\u201d or \u201cpersistent\u201d cookies are cookies that remain saved even after the browser is closed. For example, the login status can be saved if the user visits the site several days later. Likewise, the interests of the user can be saved in such a cookie and used for reach measurement or marketing purposes. \u201cThird-party cookies\u201d are cookies that are offered by providers other than the controller who operates the online service (otherwise, if they are only their cookies, they are referred to as \u201cfirst-party cookies\u201d).<\/p>\n

We may use temporary and permanent cookies and explain this in our privacy policy.<\/p>\n

If users do not want cookies to be stored on their computer, they are asked to deactivate the corresponding option in the system settings of their browser. Stored cookies can be deleted in the system settings of the browser. The exclusion of cookies can lead to functional restrictions of this online service.<\/p>\n

A general objection to the use of cookies used for online marketing purposes can be made for a large number of services, especially in the case of tracking, via the US website\u00a0http:\/\/www.aboutads.info\/choices\/<\/a>\u00a0or the EU side\u00a0http:\/\/www.youronlinechoices.com\/<\/a>\u00a0Furthermore, cookies can be blocked by deactivating them in the browser settings. The legal basis for the processing of personal data in this context is Art. 6 (1) (c) GDPR and Art. 6 (1) (f) GDPR. Our legitimate interest is the management of the cookies and similar technologies used and the related consents.<\/p>\n

The provision of personal data is not contractually required and is not necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we cannot manage your consents.<\/p>\n

<\/span>deletion of data<\/span><\/h3>\n

The data we process is deleted or restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this privacy policy, the data stored by us is deleted as soon as it is no longer required for its intended purpose and there are no statutory retention periods that prevent deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.<\/p>\n

According to legal requirements in Germany, storage takes place in particular for 10 years in accordance with Sections 147 Para. 1 AO, 257 Para. 1 No. 1 and 4, Para. 4 HGB (books, records, management reports, accounting documents, commercial books, documents relevant for taxation, etc.) and 6 years in accordance with Section 257 Para. 1 No. 2 and 3, Para. 4 HGB (commercial letters).<\/p>\n

According to legal requirements in Austria, storage takes place in particular for 7 years in accordance with Section 132 Paragraph 1 BAO (accounting documents, receipts\/invoices, accounts, receipts, business papers, statements of income and expenditure, etc.), for 22 years in connection with real estate and for 10 years for documents in connection with electronically provided services, telecommunications, radio and television services that are provided to non-entrepreneurs in EU member states and for which the Mini One Stop Shop (MOSS) is used.<\/p>\n

<\/span>participation in affiliate partner programs<\/span><\/h3>\n

Within our online offering, we use industry-standard tracking measures based on our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offering) in accordance with Art. 6 Paragraph 1 Letter f of GDPR, insofar as these are necessary for the operation of the affiliate system. Below we explain the technical background to users.<\/span><\/p>\n

The services offered by our contractual partners can also be advertised and linked on other websites (so-called affiliate links or after-buy systems, for example when links or services from third parties are offered after a contract has been concluded). The operators of the respective websites receive a commission when users follow the affiliate links and then take advantage of the offers.<\/p>\n

In summary, it is necessary for our online offering that we can track whether users who are interested in affiliate links and\/or the offers available from us subsequently take advantage of the offers at the instigation of the affiliate links or our online platform. For this purpose, the affiliate links and our offers are supplemented with certain values that are part of the link or can be set elsewhere, e.g. in a cookie. The values include in particular the source website (referrer), time, an online identifier of the operator of the website on which the affiliate link was located, an online identifier of the respective offer, an online identifier of the user, as well as tracking-specific values such as advertising material ID, partner ID and categorizations.<\/p>\n

The online identifiers we use for users are pseudonymous values. This means that the online identifiers themselves do not contain any personal data such as names or email addresses. They only help us to determine whether the same user who clicked on an affiliate link or was interested in an offer via our online offering has accepted the offer, i.e., for example, has concluded a contract with the provider. However, the online identifier is personal insofar as the partner company and we have the online identifier together with other user data. This is the only way the partner company can tell us whether the user has accepted the offer and whether we can, for example, pay out the bonus.<\/p>\n

<\/span>Amazon affiliate program<\/span><\/h3>\n

Based on our legitimate interests (i.e. interest in the economic operation of our online offering within the meaning of Art. 6 Para. 1 lit. f. GDPR), we are participants in the Amazon EU partner program, which was designed to provide a medium for websites through which advertising costs can be earned by placing advertisements and links to Amazon.de (so-called affiliate system). This means that as an Amazon partner, we earn from qualified purchases.<\/span><\/p>\n

Amazon uses cookies to track the origin of orders. Among other things, Amazon can recognize that you clicked on the affiliate link on this website and then purchased a product from Amazon.<\/p>\n

When users leave comments or other contributions, their IP addresses may be stored for 7 days based on our legitimate interests within the meaning of Art. 6 Paragraph 1 Letter f. of GDPR. This is done for our security in case someone leaves illegal content in comments and contributions (insults, prohibited political propaganda, etc.). In this case, we ourselves can be held liable for the comment or contribution and are therefore interested in the identity of the author.<\/span><\/p>\n

Furthermore, we reserve the right to process user information for the purpose of spam detection on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f. GDPR.<\/p>\n

On the same legal basis, we reserve the right, in the case of surveys, to store users\u2019 IP addresses for the duration of the survey and to use cookies to avoid multiple voting.<\/p>\n

The data provided in comments and contributions will be stored by us permanently until the user objects.<\/p>\n

<\/span>Retrieval of emojis and smileys<\/span><\/h3>\n

Our WordPress blog uses graphic emojis (or smileys), i.e. small graphic files that express emotions, which are obtained from external servers. The server providers collect the IP addresses of the users. This is necessary so that the emoji files can be transmitted to the users' browsers. The emoji service is offered by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. Automattic's privacy policy:\u00a0https:\/\/automattic.com\/privacy\/<\/a>The server domains used are sworg and twemoji.maxcdn.com, which, to the best of our knowledge, are so-called content delivery networks, i.e. servers that only serve to quickly and securely transmit files and the users' personal data is deleted after transmission.<\/span><\/p>\n

The use of emojis is based on our legitimate interests, i.e. interest in an attractive design of our online offering in accordance with Art. 6 (1) lit. f. GDPR.<\/p>\n

<\/span>contact<\/span><\/h3>\n

When you contact us (e.g. via contact form, email, telephone or via social media), the user's details are processed to process the contact request and its handling in accordance with Art. 6 Paragraph 1 Letter b) of GDPR. Users' details may be stored in a customer relationship management system ("CRM system") or comparable inquiry organization.<\/span><\/p>\n

We delete the requests if they are no longer required. We check the necessity every two years; statutory archiving obligations also apply.<\/p>\n

<\/span>newsletter<\/span><\/h3>\n

With the following information we inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedures as well as your right of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.<\/span><\/p>\n

Content of the newsletter: We only send newsletters, emails and other electronic notifications with advertising information (hereinafter "newsletter") with the consent of the recipient or with legal permission. If the contents of the newsletter are specifically described when registering for the newsletter, they are decisive for the user's consent. Otherwise, our newsletters contain information about our services and us.<\/p>\n

Double opt-in and logging: Registration for our newsletter is carried out using a so-called double opt-in process. This means that after registration you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can register using someone else's email address. Registrations for the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation, as well as the IP address. Changes to your data stored by the shipping service provider are also logged.<\/p>\n

Registration data: To register for the newsletter, it is sufficient to provide your email address. Optionally, we ask you to provide a name so that we can address you personally in the newsletter.<\/p>\n

The newsletter is sent and its associated performance measurement is based on the consent of the recipient in accordance with Art. 6 Para. 1 lit. a, Art. 7 GDPR in conjunction with Section 7 Para. 2 No. 3 UWG or, if consent is not required, on the basis of our legitimate interests in direct marketing in accordance with Art. 6 Para. 1 lit. f. GDPR in conjunction with Section 7 Para. 3 UWG.<\/p>\n

The registration process is logged on the basis of our legitimate interests in accordance with Art. 6 (1) (f) GDPR. Our interest is in using a user-friendly and secure newsletter system that serves our business interests and meets the expectations of users and also allows us to provide evidence of consent.<\/p>\n

Cancellation\/Revocation - You can cancel your subscription to our newsletter at any time, i.e. revoke your consent. You will find a link to cancel the newsletter at the end of each newsletter. We can store the unsubscribed email addresses for up to three years on the basis of our legitimate interests before we delete them in order to be able to prove that consent was previously given. The processing of this data is limited to the purpose of a possible defense against claims. An individual request for deletion is possible at any time, provided that the previous existence of consent is confirmed at the same time.<\/p>\n

<\/span>Newsletter \u2013 Mailchimp<\/span><\/h3>\n

The newsletter is sent using the shipping service provider \u201cMailChimp\u201d, a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. You can view the shipping service provider\u2019s data protection regulations here:\u00a0https:\/\/mailchimp.com\/legal\/privacy\/<\/a>The Rocket Science Group LLC d\/b\/a MailChimp is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with the European data protection level (https:\/\/www.privacyshield.gov\/participant?id=a2zt0000000TO6hAAG&status=Active<\/a>The shipping service provider is used on the basis of our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR and a contract for data processing in accordance with Art. 28 Para. 3 S. 1 GDPR.<\/span><\/p>\n

The shipping service provider can use the recipients' data in pseudonymous form, i.e. without assignment to a user, to optimize or improve its own services, e.g. for the technical optimization of the sending and presentation of the newsletter or for statistical purposes. However, the shipping service provider does not use the data of our newsletter recipients to write to them directly or to pass the data on to third parties.<\/p>\n

<\/span>hosting and email delivery<\/span><\/h3>\n

The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, e-mail sending, security services and technical maintenance services, which we use for the purpose of operating this online offering.<\/span><\/p>\n

In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors to this online offer on the basis of our legitimate interests in the efficient and secure provision of this online offer in accordance with Art. 6 Para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing contract).<\/p>\n

<\/span>Google Tag Manager<\/span><\/h3>\n

Google Tag Manager is a solution that allows us to manage so-called website tags via an interface (and thus integrate Google Analytics and other Google marketing services into our online offering, for example). The Tag Manager itself (which implements the tags) does not process any personal data of users. With regard to the processing of users' personal data, reference is made to the following information on Google services. <\/span>Google Analytics<\/span><\/h3>\n

Based on our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offering within the meaning of Art. 6 Para. 1 lit. f. GDPR), we use Google Analytics, a web analysis service of Google LLC ("Google"). Google uses cookies. The information generated by the cookie about the use of the online offering by users is usually transferred to a Google server in the USA and stored there.<\/span><\/p>\n

Google is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law (https:\/\/www.privacyshield.gov\/participant?id=a2zt000000001L5AAI&status=Active<\/a>).<\/p>\n

Google will use this information on our behalf to evaluate the use of our website by users, to compile reports on the activities within this website and to provide us with other services related to the use of this website and the Internet. Pseudonymous user profiles can be created from the processed data.<\/p>\n

We only use Google Analytics with activated IP anonymization. This means that the user's IP address is shortened by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.<\/p>\n

The IP address transmitted by the user's browser will not be merged with other data from Google. Users can prevent the storage of cookies by setting their browser software accordingly; users can also prevent Google from collecting the data generated by the cookie and relating to their use of the website and from processing this data by downloading and installing the browser plug-in available under the following link:\u00a0http:\/\/tools.google.com\/dlpage\/gaoptout?hl=de<\/a>.<\/p>\n
