The term is broad and covers practically any handling of data.<\/p>\n<p>\u2018Pseudonymisation\u2019 means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.<\/p>\n<p>\u2018Profiling\u2019 means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person\u2019s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.<\/p>\n<p>The \u201ccontroller\u201d means the natural or legal person, public authority, agency or other body which alone or jointly with others decides on the purposes and means of the processing of personal data.<\/p>\n<p>\u201cProcessor\u201d means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.<\/p>\n<h3 id=\"dsg-general-legalbasis\"><span id=\"Massgebliche_Rechtsgrundlagen\" class=\"ez-toc-section\"><\/span><span id=\"Massgebliche_Rechtsgrundlagen\">Relevant legal bases<\/span><\/h3>\n<p>In accordance with Art. 13 GDPR, we will inform you of the legal basis for our data processing. If the legal basis is not mentioned in the data protection declaration, the following applies: The legal basis for obtaining consent is Art. 6 Para. 1 lit. a and Art. 7 GDPR, the legal basis for processing to fulfill our services and carry out contractual measures as well as answering inquiries is Art. 6 Para. 1 lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 Para. 1 lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Art. 6 Para. 1 lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 Para. 1 lit. d GDPR serves as the legal basis.<\/p>\n<h3 id=\"dsg-general-securitymeasures\"><span id=\"Sicherheitsmassnahmen\" class=\"ez-toc-section\"><\/span><span id=\"Sicherheitsmassnahmen\">security measures<\/span><\/h3>\n<p>In accordance with Art. 32 GDPR, we take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons.<\/p>\n<p>The measures include in particular ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to it, input, transfer, ensuring availability and separation. Furthermore, we have set up procedures that ensure the exercise of data subject rights, deletion of data and response to data threats. Subject to legal or contractual permissions, we only process or have data processed in a third country if the special requirements of Art. 44 ff. GDPR are met. This means that the processing takes place, for example, on the basis of special guarantees, such as the officially recognised determination of a data protection level corresponding to that of the EU (e.g. for the USA through the \u201cPrivacy Shield\u201d) or compliance with officially recognised special contractual obligations (so-called \u201cstandard contractual clauses\u201d).<\/p>\n<h3 id=\"dsg-general-rightssubject\"><span id=\"Rechte_der_betroffenen_Personen\" class=\"ez-toc-section\"><\/span><span id=\"Rechte_der_betroffenen_Personen\">rights of the data subjects<\/span><\/h3>\n<p>You have the right to request confirmation as to whether or not data concerning you is being processed and to request information about this data as well as further information and a copy of the data in accordance with Art. 15 GDPR.<\/p>\n<p>According to Art. 16 GDPR, you have the right to request that the data concerning you be completed or that inaccurate data concerning you be corrected.<\/p>\n<p>In accordance with Art. 17 GDPR, you have the right to request that the data in question be deleted immediately or, alternatively, to request that the processing of the data be restricted in accordance with Art. 18 GDPR.<\/p>\n<p>You have the right to request that we receive the data concerning you that you have made available to us in accordance with Art. 20 GDPR and to request that it be transmitted to other responsible parties.<\/p>\n<p>You also have the right to lodge a complaint with the competent supervisory authority in accordance with Art. 77 GDPR.<\/p>\n<h3 id=\"dsg-general-revokeconsent\"><span id=\"Widerrufsrecht\" class=\"ez-toc-section\"><\/span><span id=\"Widerrufsrecht\">right of withdrawal<\/span><\/h3>\n<p>You have the right to revoke consent granted in accordance with Art. 7 Para. 3 GDPR with effect for the future<\/p>\n<h3 id=\"dsg-general-object\"><span id=\"Widerspruchsrecht\" class=\"ez-toc-section\"><\/span><span id=\"Widerspruchsrecht\">right of objection<\/span><\/h3>\n<p>You can object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. The objection can be made in particular against processing for direct marketing purposes.<\/p>\n<h3 id=\"dsg-general-cookies\"><span id=\"Cookies_und_Widerspruchsrecht_bei_Direktwerbung\" class=\"ez-toc-section\"><\/span><span id=\"Cookies_und_Widerspruchsrecht_bei_Direktwerbung\">Cookies and the right to object to direct advertising<\/span><\/h3>\n<p>\u201cCookies\u201d are small files that are saved on users\u2019 computers. Different information can be saved within cookies. A cookie is primarily used to save information about a user (or the device on which the cookie is saved) during or after their visit to an online service. Temporary cookies, or \u201csession cookies\u201d or \u201ctransient cookies\u201d, are cookies that are deleted after a user leaves an online service and closes their browser. Such a cookie can store, for example, the contents of a shopping cart in an online shop or a login status. \u201cPermanent\u201d or \u201cpersistent\u201d cookies are cookies that remain saved even after the browser is closed. For example, the login status can be saved if the user visits the site several days later. Likewise, the interests of the user can be saved in such a cookie and used for reach measurement or marketing purposes. \u201cThird-party cookies\u201d are cookies that are offered by providers other than the controller who operates the online service (otherwise, if they are only their cookies, they are referred to as \u201cfirst-party cookies\u201d).<\/p>\n<p>We may use temporary and permanent cookies and explain this in our privacy policy.<\/p>\n<p>If users do not want cookies to be stored on their computer, they are asked to deactivate the corresponding option in the system settings of their browser. Stored cookies can be deleted in the system settings of the browser. Our legitimate interest is the management of the cookies and similar technologies used and the related consents.<\/p>\n<p>The provision of personal data is not contractually required and is not necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we cannot manage your consents.<\/p>\n<h3 id=\"dsg-general-erasure\"><span id=\"Loeschung_von_Daten\" class=\"ez-toc-section\"><\/span><span id=\"Loeschung_von_Daten\">deletion of data<\/span><\/h3>\n<p>The data we process is deleted or restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this privacy policy, the data stored by us is deleted as soon as it is no longer required for its intended purpose and there are no statutory retention periods that prevent deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.<\/p>\n<p>According to legal requirements in Germany, storage takes place in particular for 10 years in accordance with Sections 147 Para. 1 AO, 257 Para. 1 No. 1 and 4, Para. 4 HGB (books, records, management reports, accounting documents, commercial books, documents relevant for taxation, etc.) and 6 years in accordance with Section 257 Para. 1 No. 2 and 3, Para. 4 HGB (commercial letters).<\/p>\n<p>According to legal requirements in Austria, storage takes place in particular for 7 years in accordance with Section 132 Paragraph 1 BAO (accounting documents, receipts\/invoices, accounts, receipts, business papers, statements of income and expenditure, etc.), for 22 years in connection with real estate and for 10 years for documents in connection with electronically provided services, telecommunications, radio and television services that are provided to non-entrepreneurs in EU member states and for which the Mini One Stop Shop (MOSS) is used.<\/p>\n<h3 id=\"dsg-affiliate-general\"><span id=\"Teilnahme_an_Affiliate-Partnerprogrammen\" class=\"ez-toc-section\"><\/span><span id=\"Teilnahme_an_Affiliate-Partnerprogrammen\">participation in affiliate partner programs<\/span><\/h3>\n<p><span class=\"ts-muster-content\">Within our online offering, we use industry-standard tracking measures based on our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offering) in accordance with Art. 6 Paragraph 1 Letter f of GDPR, insofar as these are necessary for the operation of the affiliate system. Below we explain the technical background to users.<\/span><\/p>\n<p>The services offered by our contractual partners can also be advertised and linked on other websites (so-called affiliate links or after-buy systems, for example when links or services from third parties are offered after a contract has been concluded). The operators of the respective websites receive a commission when users follow the affiliate links and then take advantage of the offers.<\/p>\n<p>In summary, it is necessary for our online offering that we can track whether users who are interested in affiliate links and\/or the offers available from us subsequently take advantage of the offers at the instigation of the affiliate links or our online platform. For this purpose, the affiliate links and our offers are supplemented with certain values that are part of the link or can be set elsewhere, e.g. in a cookie. The values include in particular the source website (referrer), time, an online identifier of the operator of the website on which the affiliate link was located, an online identifier of the respective offer, an online identifier of the user, as well as tracking-specific values such as advertising material ID, partner ID and categorizations.<\/p>\n<p>The online identifiers we use for users are pseudonymous values. This means that the online identifiers themselves do not contain any personal data such as names or email addresses. They only help us to determine whether the same user who clicked on an affiliate link or was interested in an offer via our online offering has accepted the offer, i.e., for example, has concluded a contract with the provider. However, the online identifier is personal insofar as the partner company and we have the online identifier together with other user data. This is the only way the partner company can tell us whether the user has accepted the offer and whether we can, for example, pay out the bonus.<\/p>\n<h3 id=\"dsg-affiliate-amazon\"><span id=\"Amazon-Partnerprogramm\" class=\"ez-toc-section\"><\/span><span id=\"Amazon-Partnerprogramm\">Amazon affiliate program<\/span><\/h3>\n<p><span class=\"ts-muster-content\">Based on our legitimate interests (i.e. interest in the economic operation of our online offering within the meaning of Art. 6 Para. 1 lit. f. GDPR), we are participants in the Amazon EU partner program, which was designed to provide a medium for websites through which advertising costs can be earned by placing advertisements and links to Amazon.de (so-called affiliate system). This means that as an Amazon partner, we earn from qualified purchases.<\/span><\/p>\n<p>Amazon uses cookies to track the origin of orders. In this case, we ourselves can be held liable for the comment or contribution and are therefore interested in the identity of the author.<\/span><\/p>\n<p>Furthermore, we reserve the right to process user information for the purpose of spam detection on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f. GDPR.<\/p>\n<p>On the same legal basis, we reserve the right, in the case of surveys, to store users\u2019 IP addresses for the duration of the survey and to use cookies to avoid multiple voting.<\/p>\n<p>The data provided in comments and contributions will be stored by us permanently until the user objects.<\/p>\n<h3 id=\"dsg-wordpress-emojis\"><span id=\"Abruf_von_Emojis_und_Smilies\" class=\"ez-toc-section\"><\/span><span id=\"Abruf_von_Emojis_und_Smilies\">Retrieval of emojis and smileys<\/span><\/h3>\n<p><span class=\"ts-muster-content\">Our WordPress blog uses graphic emojis (or smileys), i.e. small graphic files that express emotions, which are obtained from external servers. The server providers collect the IP addresses of the users. This is necessary so that the emoji files can be transmitted to the users&#039; browsers. The emoji service is offered by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. Automattic&#039;s privacy policy:\u00a0<a href=\"https:\/\/automattic.com\/privacy\/\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/automattic.com\/privacy\/<\/a>The server domains used are sworg and twemoji.maxcdn.com, which, to the best of our knowledge, are so-called content delivery networks, i.e. servers that only serve to quickly and securely transmit files and the users&#039; personal data is deleted after transmission.<\/span><\/p>\n<p>The use of emojis is based on our legitimate interests, i.e. interest in an attractive design of our online offering in accordance with Art. 6 (1) lit. f. GDPR.<\/p>\n<h3 id=\"dsg-contact\"><span id=\"Kontaktaufnahme\" class=\"ez-toc-section\"><\/span><span id=\"Kontaktaufnahme\">contact<\/span><\/h3>\n<p><span class=\"ts-muster-content\">When you contact us (e.g. via contact form, email, telephone or via social media), the user&#039;s details are processed to process the contact request and its handling in accordance with Art. 6 Paragraph 1 Letter b) of GDPR. Users&#039; details may be stored in a customer relationship management system (&quot;CRM system&quot;) or comparable inquiry organization.<\/span><\/p>\n<p>We delete the requests if they are no longer required.
